Welcome to PocketWell. These Terms and Conditions (“Terms”) govern your access to and use of the PocketWell website, platform, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the Service.
1. Overview
PocketWell is a digital platform operated in Australia that enables users (“Hosts”) to create personalised event pages for occasions such as weddings, birthdays, and baby showers. These pages allow friends and family (“Guests”) to send well wishes or monetary gifts online.
PocketWell provides the platform infrastructure only. Payments and payouts are processed by Stripe, a third-party payment service provider. Stripe facilitates the transfer of funds directly to Hosts’ nominated bank accounts in accordance with Stripe’s terms and verification requirements.
PocketWell does not act as a bank, escrow service, or money transmitter and does not hold funds on behalf of users.
2. Eligibility
To use PocketWell, you must:
- Be at least 18 years of age
- Reside in Australia
- Have the legal capacity to enter into a binding contract
- Agree to comply with these Terms and all applicable laws
3. Account Registration
To host events on PocketWell, you must create an account. By registering, you agree to:
- Provide accurate and complete information
- Keep your login credentials secure
- Notify PocketWell immediately of any unauthorised access
- Accept responsibility for all activity under your account
PocketWell may suspend or terminate accounts that violate these Terms or involve fraudulent, abusive, or unlawful activity.
4. Using the Platform
4.1 Hosts
Hosts may create event pages and share them with Guests. Hosts can view gifts received through their dashboard.
To receive payouts, Hosts must complete Stripe’s onboarding and identity verification process. Once verified, payouts are processed by Stripe and sent directly to the Host’s nominated bank account. Payout timing depends on Stripe’s processing schedules, verification status, and banking systems.
4.2 Guests
Guests may access an event page via a shared link and send monetary gifts with optional messages. Payments are processed securely by Stripe. The net amount (after applicable fees) is made available for payout to the Host in accordance with Stripe’s payout process.
4.3 Fees
Guests are responsible for the following fees at the time of payment:
- Service Fee: 3% of the transaction amount
- Payment processing fee: 1.75% + $0.30 per transaction
All fees are displayed transparently before payment confirmation.
5. Payments and Payouts
PocketWell uses Stripe to process all payments made through the platform. Stripe collects payments from Guests and facilitates payouts directly to Hosts’ nominated bank accounts.
Hosts must complete Stripe onboarding and verification before receiving payouts. Payouts are subject to Stripe’s terms, verification requirements, processing times, and banking schedules.
PocketWell does not store, control, or hold user funds and is not responsible for delays, holds, chargebacks, or failed payouts resulting from Stripe’s processes, incorrect bank details, or external banking issues.
5B. Taxes
Hosts are solely responsible for determining, reporting, and paying any taxes, duties, or government charges that may apply to gifts, contributions, or other amounts received through PocketWell.
PocketWell does not provide tax advice and does not calculate, collect, withhold, or remit taxes on behalf of Hosts, except where required by law. PocketWell is not responsible for any tax obligations arising from your use of the Service, including but not limited to income tax, goods and services tax (GST), or any other local, state, or federal taxes.
You are encouraged to seek independent tax advice to understand your obligations.
5A. Legacy Payout Arrangements (Users Registered Before 7 January 2026)
Prior to 7 January 2026, PocketWell supported a limited number of Hosts through legacy payout arrangements, including manual bank transfers.
These legacy arrangements were transitional and applied only to specific users during an earlier phase of the platform.
PocketWell may continue to honour existing legacy payout arrangements for eligible Hosts at its discretion. PocketWell reserves the right to modify, suspend, or discontinue legacy payout methods at any time and to require all Hosts to transition to Stripe-powered payouts in order to continue receiving payments through the platform.
Nothing in these Terms creates an obligation for PocketWell to continue supporting any legacy payout method indefinitely.
All users who register on or after 7 January 2026 must use Stripe-powered payouts.
6. No Refunds
All contributions made via PocketWell are considered personal gifts to the Host and are non-refundable.
PocketWell does not mediate disputes or provide refunds. Any disagreements or refund requests must be resolved directly between the Guest and the Host.
Refunds, chargebacks, and payment disputes may also be subject to Stripe’s dispute resolution processes.
7. User Conduct
You agree not to:
- Violate any laws or third-party rights
- Submit false, misleading, or fraudulent information
- Upload malware, spam, or harmful content
- Interfere with the security or operation of the Service
- Create multiple or deceptive accounts
PocketWell may take appropriate action, including suspension or termination, for any breach of this section.
8. Intellectual Property
All trademarks, software, branding, and content (excluding user-submitted content) are owned by PocketWell or its licensors.
By submitting content, users grant PocketWell a limited, non-exclusive licence to use, display, and distribute such content within the platform.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind.
PocketWell is not responsible for:
- User conduct
- User-generated content
- The performance of third-party services, including Stripe
10. Limitation of Liability
To the maximum extent permitted by law, PocketWell is not liable for:
- Indirect or consequential losses
- Disputes between Hosts and Guests
- Delays caused by third-party services or banks
- Platform outages or interruptions
PocketWell’s total liability is limited to the service fees paid to PocketWell by you in the 12 months preceding the event giving rise to the claim.
11. Termination
PocketWell may suspend or terminate accounts for:
- Breach of these Terms
- Fraudulent or suspicious activity
- Legal or regulatory requirements
Users may close their account by contacting support@pocketwell.com.au. Termination does not release users from obligations arising before account closure.
12. Changes to These Terms
PocketWell may update these Terms from time to time. Material changes will be communicated via email or website notice. Continued use of the Service constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
